Warranty Policy
1. Limited Warranty
R&L Jones Engineering, trading as T-Rex Manufacturing warrants that all products manufactured by T-Rex Manufacturing and/or supplied by T-Rex Manufacturing to be free from defects in materials and workmanship under normal use for the applicable period outlined in Section 2 below (the applicable “Warranty Period”), commencing from the invoice date of the product.
2. Applicable Warranty Periods
2.1 Top Dog Hose Reels which are not customised – Two (2) years
(a) Hose – Twelve (12) months
2.2 Water Cannons purchased as a kit – Two (2) years
(a) Water valves purchased as part of a water cannon kit – Twelve (12) months
2.3 All other products – Twelve (12) months
2.4 Notwithstanding the foregoing items, this Limited Warranty does not cover any wear and tear items including but not limited to o-rings, seals, rollers, diaphragms, bushes, springs (excluding Top Dog Hose Reel spring).
3. Conditions of Warranty
3.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
3.2 For major failures with the product, T-Rex Manufacturing will repair or replace the product.
3.3 If the failure with the goods does not amount to a major failure, T-Rex Manufacturing may provide parts to You to carry out repairs to the product.
3.4 T-Rex Manufacturing reserves the right to determine, at its sole discretion, whether a product fault is classified as major or otherwise.
4. Certain Exclusions From and Conditions of Warranty
4.1 This Limited Warranty does not cover normal maintenance, or adjustments, nor does it cover damage relating to:
(a) Any accident, alteration, misuse, neglect, negligence, abuse, vandalism or physical damage.
(b) Any unauthorised repair, replacement or alteration, including without limitation by any facility not approved in advance by T-Rex Manufacturing;
(c) Improper installation (including electrical damage caused by improper installation) or failure to follow installation instructions provided by T-Rex Manufacturing;
(d) Any use inconsistent with the instruction manual, safety warnings, product labelling, datasheets, specification sheets and/or other installation, use, operation and technical documentation provided and/or published by T-Rex Manufacturing;
(e) Any use of equipment or parts not manufactured by T-Rex Manufacturing;
(f) Any explosion, implosion, flood, earthquake, lightning strike, acid rain, chemical fallout, catastrophic event, or other act of God or nature;
(g) Exposure to severe environmental conditions or unintended uses and/or substances;
(h) Acts or omissions of any carrier delivering any Products;
(i) Any failure to provide reasonable maintenance or to care for or maintain any product in accordance with the Documentation.
4.2 T-Rex Manufacturing’s obligations in the event of 3.2 and 3.3 do not include:
(a) the cost of removal of the defective product whether installed or otherwise;
(b) the cost of installation of replacement for defective product;
(c) the cost of transporting the product to and from the Company for investigation or repair (this may be assessed on a case-by-case basis);
(d) or defects in product caused by improper installation or maintenance of the product or related components or normal wear and tear and damage
4.3 Risk in the product remains with You at all times whilst they are being investigated or repaired by T- Rex Manufacturing and T-Rex Manufacturing and its employees or agents will not be liable for any damage to the Goods unless the damage is caused by the gross neglect of T-Rex Manufacturing or its employees or agents.
5. Making of Claims; Return and Replacement; Exclusive Remedy
5.1 Subject to law and during the Applicable Warranty Period, T-Rex Manufacturing’s obligations to you as part of this Limited Warranty or Terms and Conditions shall, at T-Rex Manufacturing’s option be limited to the repair or replacement of the product or component which T-Rex Manufacturing, in its absolute discretion, determines to be defective in materials or workmanship under normal use and service.
5.2 To qualify for coverage under this Limited Warranty, You must:
(a) contact T-Rex Manufacturing for a Return Merchandise Authorisation (RMA) Number prior to return and include such number on the return, and
(b) return any and all allegedly defective product (and parts thereof) to T-Rex Manufacturing at the address supplied, transportation charges prepaid, within a reasonable time after discovery of the alleged defect, but in no event later than thirty (30) days after the expiration of the Appliable Warranty Period. This Limited Warranty automatically shall terminate (and T-Rex Manufacturing will have no further liability or obligation of any kind) with respect to any items not so returned within such thirty (30)-day period.
6. Limitations on Liability; Certain Other Limitations
6.1 Subject to law, the Company will not be liable to You or any other person under any circumstances for any direct, incidental or consequential loss or damage (including loss or damage caused by negligence or wilful acts default of T-Rex Manufacturing, its employees or agents) whatsoever arising from a breach of any of the T-Rex Manufacturing’s Terms and Conditions or any other statutory implied warranty, terms or conditions in relation to the Goods and/or Services.
6.2 Subject to law, T-Rex Manufacturing will not be liable for any costs, claims, damages or demands arising from personal injury, loss or damage to Goods whatsoever occurring to You or Your employees or agents by reason of:
(a) the product, their design, production or processing;
(b) any act or omission of T-Rex Manufacturing, its servants and agents; or
(c) any statement or representation made by an employee or agent of T-Rex Manufacturing.
6.3 The Company will not be responsible for the consequences of any technical advice given by its employees in relation to the design, specifications, installations or use of the Goods.
